Acceptance of the EULA
PLEASE CAREFULLY READ THIS END USER LICENSE AGREEMENT (“EULA”) PRIOR TO PURCHASING OR USING THE Highster Mobile APPLICATION SOFTWARE (HEREINAFTER – SOFTWARE/LICENSED SOFTWARE). BY PURCHASING OR USING THE SOFTWARE, YOU AGREE TO ADHERE TO THE TERMS OF THIS EULA. IF YOU DO NOT ACCEPT THE TERMS OF THIS LICENSE, DO NOT INSTALL OR USE THE SOFTWARE AND DELETE THE SOFTWARE AND ALL OF ITS RELATED FILES FROM YOUR DEVICE.
THIS EULA IS A LEGAL AGREEMENT BETWEEN YOU (THE USER) AND Highster Mobile (THE APPLICATION PROVIDER) FOR USE OF THE SOFTWARE. BY DOWNLOADING, INSTALLING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE, YOU MAY NOT DOWNLOAD, INSTALL, OR USE THE SOFTWARE.
Devices, Accounts, and Notice Requirements
BY ACCEPTING THIS EULA, YOU AGREE TO INSTALL THIS SOFTWARE ONLY ON A DEVICE OR DEVICES OWNED BY YOU AND, FOR CLOUD-BASED OR OTHER MONITORING THAT DOES NOT REQUIRE INSTALLATION ON A DEVICE, TO USE IT ONLY IN CONNECTION WITH AN ACCOUNT, APPLICATION, OR PROGRAM YOU HAVE THE LEGAL RIGHT TO ACCESS.
YOU ALSO AGREE TO INFORM ANY PERSON(S) WHO USE(S) A DEVICE WITH THE SOFTWARE INSTALLED AND ANY OTHER PERSON WITH THE RIGHT TO ACCESS A MONITORED ACCOUNT OF THE PRESENCE OF THE SOFTWARE. FAILURE TO COMPLY MAY RESULT IN BREAKING APPLICABLE LAW. YOU SHALL BE RESPONSIBLE FOR ANY LEGAL COSTS INCURRED BY THE APPLICATION PROVIDER OR AFFECTED PERSONS RESULTING FROM YOUR IMPROPER OR ILLEGAL USE OF THE SOFTWARE.
Intended Legal Uses and Consent
- The Software shall be used for monitoring, tracking, and accessing devices (including cell phones and computers, email, text messages, etc.) of children, employees, or other device owners with their consent.
- Installation and use must comply with all applicable laws governing monitoring of devices, accounts, applications, or programs.
- Install only on devices you own or for which you have explicit permission/consent from the owner. Do not install on unauthorized devices.
- For cloud-based monitoring, use only with accounts/applications/programs you have the legal right to access.
- It is prohibited to fail to inform third parties that their device/account is monitored.
- Do not allow others to access collected information.
- Use is limited to: (i) parental control of children, (ii) employer monitoring of company-owned devices, (iii) your own devices, (iv) devices with owner consent.
Installation, Compatibility, and Technical Requirements
Physical access to the target device is required for installation. The Software cannot be installed remotely without bona fide physical possession of the device. For iOS, remote installation may use iCloud credentials but requires consent or lawful access to the owner's device.
Check the Compatibility Policy before installation. Non-compliance is your responsibility and no refund will be issued. Basic features require device compatibility; advanced features may require jailbreaking (iOS) or rooting (Android), which must comply with applicable law.
Scope of License and Legal Use
The Application Provider grants a limited, non-exclusive, non-transferable, revocable license to install the Software on devices you own/control, view/utilize data, or use for cloud-based monitoring of accounts you have the right to access.
The Software is designed for legal use only by those with the right to monitor. The Provider does not provide legal advice. You must consult your own legal advisor and take full responsibility for determining your right to monitor. The Provider is not liable if you monitor without authorization.
Improper Use, Ownership, and Restrictions
Do not use the Software to harass, abuse, stalk, threaten, defame, or violate others' rights. The Provider is not responsible for such misuse. If installed without permission, the Provider may provide uninstall instructions and block the violator's account. All server data is encrypted for privacy.
The Provider owns all rights, title, and interest in the Software and intellectual property. You acquire no ownership. You may not sell, lease, reverse engineer, modify, create derivatives, disclose, or copy the Software. Violations may result in legal action.
Consent to Data Use, Third Parties, and Termination
The Provider may collect anonymized technical data to improve services. Personal data is handled per the Privacy Policy and not disclosed except as required by law.
You are responsible for compliance with third-party terms. The license term matches your subscription; it terminates automatically on breach or expiration. Upon termination, cease use and uninstall.
Limited Warranty, Liability, and Changes
Limited warranty during subscription term for technical issues. Contact support@highster-mobile.com with proof of purchase. Sole remedy for unresolvable issues is refund per Refund Policy.
To the extent permitted by law, Highster Mobile is not liable for any damages, losses, or claims from use of the Software. The EULA may change; continued use constitutes acceptance. Governed by applicable laws.
